Dear Sisters and Brothers,

On Thursday, September 18, TWU’s Motion to Dismiss and for Summary Judgment in the case of Demetris v. TWU was argued in San Francisco before U.S. District Court Judge Vince Chhabria.
It was TWU’s contention, in the Motion, that the case should be disposed of at this early stage because plaintiffs failed to exhaust available internal union procedures and because their complaint failed to adequately state a cause of action against the union.
Although the arguments had been previously briefed by the parties (and the Judge decided to accept all of the prior written presentations), oral arguments lasted approximately two hours. We are awaiting a decision by Judge Chhabria on TWU’s Motion. (see attachment for official letter)
